Overview
As a "private estate" in the virtual world of Second Life, residency in Colonial Waikiti is governed by a Covenant.
This covenant may be amended from time to time, and provides the outlines and rules which help to keep Colonial Waikiti what it is today.
The current Covenant was last updated on March 29th, 2008.
Preamble
Waikiti has been designed as a tropical paradise, with a Polynesian / Hawaiian theme.
All private land within Waikiti is rental only, and all land has ocean or water frontage on at least one side.
This Covenant covers all regions in the Waikiti estate, and is dated March 29th, 2008.
This Covenant supercedes all previous Covenants.
Rental Rates, Terms
- All lots/parcels are rental only.
What this means is, you do not have to make any big purchase up-front.
In Waikiti estate, all you pay is monthly rent.
When you decide to rent in Waikiti, you 'buy' the land with your first month's rent.
That's all there is to it - the land is transferred to your name and you can begin building right away.
We will contact you within a day or two, to invite you to join a residents' group, and make sure your move / build is going smoothly.
- Subsequent rental payments are due every month, on the same day of the month.
For example, if you start your rental on the 23rd of the month, your next rent is due on the 23rd of the following month.
- Rental amounts vary by parcel size and region classification (Standard or Openspace).
The amount paid for your first month will be the amount you pay in subsequent months.
Rent may be paid directly to Atashi Toshihiko.
- Properties may not be sub-leased, re-rented, or "sold".
- Please be absolutely certain before you rent your parcel, as no refunds are possible.
Rental Rates by Parcel Size - Standard Regions
• 256m - "Prim bonus lot" (see below for details) - L$450 per month
• 2048m - "Half size lot" (467 prims) - L$4,000 per month
• 4096m - "Full size lot" (937 prims) - L$7,500 per month
• 8448m - "Mini-island lot" (1933 prims) - L$15,500 per month
Rental Rates by Parcel Size - Openspace Regions
• 1/2 Region (1870 prims) - L$16,250 per month
• Full Region (3740 prims) - L$32,500 per month
Discounts & Special Offers
Prepayment Discount: We are offering a discount on rent - prepay 3-months rent and take 10% off.
In other words, if the monthly rent is L$7500, for 3 months' rent you pay L$20,250 instead of L$22,500 and save L$2,250.
If you are not yet a resident and wish to take advantage of this offer, Do Not use the 'buy land' tool; instead please
send an IM to Atashi Toshihiko letting us know which lot you want, and we will make arrangements with you directly.

Code of Conduct
- No harassment, stalking, 'griefing' or troublemaking of any kind will be tolerated.
- No littering -- please do not leave prims on land other than your own.
Group land is set to allow only group members to rez objects, and has a 1-minute autoreturn for any non-group objects.
- General ban-lines are prohibited. You may ban invididual avatars by name to deal with specific troublemakers, but may not set general restricted access.

- Security devices are permitted in skyboxes.
- The Code of Conduct applies to residents and guests alike.
- Residents and guests are also expected to adhere to the Second Life Terms of Service and Community Standards.
Building Codes
- Rental parcels are for Residential builds only.
Absolutely no commercial or retail builds will be permitted outside the designated areas (Waikiti Mall, Minaki Aerodrome & Business Centre).
This includes (but is not limited to): stores, billboards, rotating prims, and advertising material of any kind.
If you would like vendor space or to set up a shop please contact Atashi Toshihiko to enquire about available commercial space.
- We require that you design your ground-level buildings to fit the tropical island theme.
The overall theme of Waikiti is that of a tropical island paradise.
While we do not have an enforced time period, the public builds are dated from early to mid 20th century (circa. 1900-1950, specifically mid 1920's post-colonial.).
- Buildings must be placed a minimum of 5 meters away from all borders / property lines.
Foliage (trees, etc.) may be placed up to the property line, but parcel encroachment will not be permitted.
Prim fences / signage / hedges / etc. built within 5m of the property lines may be required to be phantom and/or alpha textured on the outside.
- Ground-level buildings have an altitude restriction of 50m (* see below). This limit will be strictly enforced. Please note this is an absolute altitude limit, NOT 50m above the water line.
- Skyboxes are welcome and the theme requirements are not enforced for skyboxes. Skyboxes must be above 500m in altitude. (* see below)
- The built-in terrain editing tools will permit you to edit the land to a limit of +/- 2 meters.
This number has been chosen to allow residents to make minor adjustments to their land, to accomodate builds or make minor adjustments to the contour of their land, without having the overall 'feel' of the regions altered.
If you require or desire terrain editing beyond these restrictions, please contact Atashi Toshihiko.
We want to make sure our residents are happy, but we also need to maintain the overall feel and style of the island.
- We reserve the right to address any 'eyesores' (structures, extreme terrain, etc.), at any altitude.
If you have any questions about the style of buildings that fit into our Tropical Island theme, please feel free to look around the regions (particularily the public areas) and get a feel for the structures already present.
You may also contact Atashi Toshihiko if you have something specific in mind and aren't sure if it would fit in.
Building Codes for Full Openspace Regions
For residents who are renting an entire (Full) Openspace region, the following building codes are in effect:
- Rented Openspace regions are for Residential builds only.

Buildings constructed prior to March 29th which do not meet with the current height build limit will be permitted to remain.

- The built-in terrain editing tools will permit you to edit the land to a limit of +/- 25 meters, however we ask that discretion is employed when making drastic changes to the terrain.
The overall feel of the islands and estate must be preserved.
Changes in terrain beyond these limits are possible, pending approval by Atashi Toshihiko.
In addition, we have the capacity to upload RAW terrain maps for bulk terraforming, also pending approval.
- We reserve the right to address any 'eyesores' (structures, extreme terrain, etc.), at any altitude.
Please note that Openspace regions were designed by Linden Lab as Light Duty regions, there may be performance isues.
We therefore reserve the right to limit or restrict activities which overtax / negatively impact the region.

Please note: These building codes apply -only- to whole-region rentals. Half- or quarter-region rentals must abide by the standard building codes.
Prim Bonus Lots
On Standard regions (Waikiti Waiki Atoll), we have made a number of small (256m) lots available as "prim bonus" lots.
These lots are designed to allow existing residents to increase their prim limits on their own parcels.
Each "prim bonus" lot supports 58 prims. (* see below)
Prim bonus lots are available on a first-come, first-served basis.
Only existing residents may hold "prim bonus" lots, they are not for use as a small standalone lot or for building permanent structures.

(*) Explanations of Recent Changes
- March 29th:Openspace regions are now Residential Only. No new commercial builds will be permitted.
- March 29th:More text has been cleaned up and made more specific to try avoiding misunderstandings.
- March 16th:We have raised the maximum build height from 40m to 50m. In the past, the 40m limit was frequently broken and exceptions were granted on a case-by-case basis.
From now on, the limit is 50m and it will be strictly enforced.
- March 16th:We have raised the minimum height of skyboxes to 500m. Please note: This affects New Builds Only! If you have an existing skybox between 350m and 500m you may leave it where it is.
In the future we may ask that existing skyboxes are raised to 500m or above, but for now you do not have to move anything. Only New skyboxes need to go above 500m.
- March 16th:Prim Bonus Lots are no longer required to hold 3 prims of plants or trees. You may use the entire 58 prims for your own use.
- March 16th:In many areas the wording has been changed slightly to be more specific and / or more direct. This is in an effort to make things clear, and reduce the possibility of misundertandings and misinterpretations.
Updates
We reserve the right to update this covenant at any time. Updated Covenants will be posted as a group notice and will be available inworld and on the website www.Waikiti.com
