Covenant

Overview

As a “private estate” in the virtual world of Second Life, residency in Colonial Waikiti is governed by a Covenant.
This covenant may be amended from time to time, and provides the outlines and rules which help to keep Colonial Waikiti what it is today.

The current Covenant was last updated on November 1st, 2008.

Preamble

Waikiti has been designed as a tropical paradise, with a Polynesian / Hawaiian theme.
All private land within Waikiti is rental only, and all rental properties have ocean or water frontage on at least one side.
This Covenant covers all regions in the Waikiti estate, and is dated November 1st, 2008.
This Covenant supercedes all previous Covenants.

Rental Rates, Terms

  1. All lots/parcels are rental only.
    What this means is, you do not have to make any big purchase or investment up-front.
    In Waikiti estate, all you pay is monthly rent.
    When you decide to rent in Waikiti, you ‘buy’ the land using the built-in SL land purchase tool, paying your first month’s rent.
  2. That’s all there is to it – the land is transferred to your name as soon as you have paid the first month rent, and you can begin building right away.
  3. We will contact you within a day or two, to invite you to join a residents’ group, and make sure your move / build is going smoothly.
  4. Subsequent rental payments are due every month, on the same day of the month as the day you paid the deposit.
    For example, if you start your rental on the 23rd of the month, your next rent is due on the 23rd of the following month.
  5. Rental amounts vary by parcel size and region classification (Standard or Openspace).
    Rent may be paid directly to Atashi Toshihiko via her profile.
  6. Properties may not be sub-leased, re-rented, or “sold”.
  7. Please be absolutely certain before you rent your parcel, there will be no refunds.

Rental Rates by Parcel Size
   • ~448m – “Waikiti Shopping Villa lot” (~100 prims) – L$750 / month (* see below)
   • 2,048m – “Half size lot” (467 prims) – L$4,000 per month
   • 4,096m – “Full size lot” (937 prims) – L$7,500 per month
   • 8,448m – “Mini-island lot” (1,933 prims) – L$15,500 per month
   • 16,384m – “Quarter Sim lot” (3,750 prims) – L$30,000 per month

10% Off! — We are offering a discount on rent – prepay 3-months rent and take 10% off!
In other words, if the monthly rent is L$7500, for 3 months’ rent you pay L$20,250 instead of L$22,500 and save L$2,250.

Code of Conduct

  1. No harassment, stalking, ‘griefing’ or troublemaking of any kind will be tolerated.
  2. No littering — please do not leave prims on land other than your own.
    Group land is set to allow only group members to rez objects, and has a 1-minute autoreturn for any non-group objects.
  3. General ban-lines are prohibited. You may ban invididual avatars by name to deal with specific troublemakers, but may not set general restricted access.
    If you need assistance with the land access settings please contact one of our Estate Managers.
  4. Residents are expected to adhere to the Building Codes described below, and keep their ground-level builds in accordance with the estate’s overal theme.
  5. The Code of Conduct applies to residents and guests alike.
  6. Residents and guests are also expected to adhere to the Second Life Terms of Service and Community Standards.

Building Codes

  1. Rental parcels are for Residential builds only.
    Absolutely no commercial or retail builds will be permitted outside the designated areas (Waikiti Shopping Area, Minaki Aerodrome & Business Centre).
    This includes (but is not limited to): stores, billboards, rotating prims, and advertising material of any kind.
    If you would like vendor space or to set up a shop please contact Atashi Toshihiko to enquire about available commercial space.
  2. We require that you design your ground-level buildings to fit the tropical island theme.
    The overall theme of Waikiti is that of a tropical island paradise.
    While we do not have an enforced time period, the public builds are dated from early to mid 20th century (circa 1900-1950, specifically mid 1920’s post-colonial.).
  3. Buildings must be placed a minimum of 5 meters away from all borders / property lines.
    Foliage (trees, etc.) may be placed up to the property line, but parcel encroachment will not be permitted.
    Prim fences / signage / hedges / etc. built within 5m of the property lines may be required to be phantom and/or alpha textured on the outside.
  4. Ground-level buildings have an altitude restriction of 50m. This limit will be strictly enforced. Please note this is an absolute altitude limit, NOT 50m above the water line.
  5. Skyboxes are welcome and the theme requirements are not enforced for skyboxes. Skyboxes must be above 500m in altitude.
  6. The built-in terrain editing tools will permit you to edit the land to a limit of +/- 2 meters.
    This number has been chosen to allow residents to make minor adjustments to their land, to accomodate builds or make minor adjustments to the contour of their land, without having the overall ‘feel’ of the regions altered.
    If you require or desire terrain editing beyond these restrictions, please contact one of our Estate Managers.
    We want to make sure our residents are happy, but we also need to maintain the overall feel and style of the estate.
  7. Security Devices (orbs, security bots, etc) may be placed only in skyboxes.
  8. Particles / Fullbright / Glow / Light Emissive / Temp Rezzers: Please ensure that particle rezzers are in-theme, tasteful, and that particles do not move beyond your property.
    Fullbright / Glow prims must also be in-theme and tasteful. Light-emitting prims must be tasteful and not cast light beyond your property lines.
    Temp rezzers may be used if used as intended, i.e. for rezzing temporary objects.
    Temp rezzers which are found to be abusing system resources will be returned.
  9. Object Entry & Scripts: The Waikiti community is built around our waterways and open airspace; boating and flying are important passtimes.
    Therefore we ask that you do not disable Object Entry or the ability to Run Scripts, as these abilities are vital to the use of vehicles.
  10. We reserve the right to address any ‘eyesores’ (structures, extreme terrain, etc.) or scripted objects we deem a ‘problem’, at any altitude.

Building Code Ammendments for lots 16,384m and Above

For residents who are renting a parcel which is sized 16,384m or higher, the following building code ammendments are in effect:

  1. Ground-level buildings have an altitude restriction of 60m. This limit will be strictly enforced. Please note this is an absolute altitude limit, NOT 60m above the water line.
  2. Terrain may be edited to a limit of +/- 25 meters. Please contact us when you plan to edit terrain, so that we can ensure the region’s terrain edit settings are correct when you are doing your work. We do ask that discretion is employed, to ensure that terrain changes are not too abrupt or drastic, so that the overall feel of the estate is preserved.
  3. Security Devices (orbs, security bots, etc.) are permitted in skyboxes. At ground level, security devices may be employed with discretion, and must not impede use of waterways.

Waikiti Shopping Village

The Waikiti Shopping Village is our main commercial/retail area. In the north-east corner of Waikiti, it has been designed to be a small “shanty-town” style with each shop having a slightly different build style.
Each shop stands on its own parcel, the average size is 448m supporting approximately 100 prims. Merchants are welcome to use the shop structure provided, or may build their own.

Shops must adhere to the island theme / style and we are strict about the period as well as the theme — tropical island, shanty town, first quarter of the 20th century (1900 – 1925). Shop structures must be no higher than 1 story (~5m high) and take up no more than 50% of the area of the parcel.
Please note – the prims of your shop structure do count against the total prims of the parcel; provided shops are designed to be low prim, 30 prims or less. Shops must have walls on at least three sides (open / door on the side facing in to the village), floor and roof, and must have plausible support (floats, posts, etc.) If in doubt, talk to one of the EMs or Atashi for guidance / feedback on your plan.

Shop parcels are deeded to the merchant, they may set the parcel name and description, landing point and other parcel features as they see fit.

Exceptions / Disputes / Contacting Us

In the event of a dispute with another resident, please contact one of our Estate Managers. We will do our best to resolve the situation.

We reserve the right to update this covenant at any time. Updated Covenants will be posted as a group notice and will be available inworld and on the website www.Waikiti.com
